BTF secured planning consent for 290 homes and completed sale of former orchard land in Kent

The subject land comprised a single parcel of agricultural land planted with top fruit orchards extended to approximately 67.70 acres (27.40Ha).

In 2016, BTF Partnership were instructed by the landowner to seek a strategic partner via either option, promotion or hybrid agreement to secure a predominantly residential led planning consent over the land.

BTF marketed the land through an informal tender process, to a select list of promoters and housebuilders. Upon receiving significant interest and offers, we shortlisted the offers through a ‘best and final bid’ process to provide the best outcome for our client. We advised the client of each offer and their individual merit. Upon shortlisting the received offers, we hosted interviews with the shortlisted party and advised our client accordingly to choose the best development partner to progress with.

A well respected Land Promoter was chosen as the development partner and commercial terms for a Promotion Agreement were negotiated by BTF. After completing contracts, on behalf of the landowners, BTF monitored the Promoter’s planning progress regularly, whilst managing the ongoing farming occupation of the site until a planning consent was achieved.

The Promoter achieved Outline Planning Consent via appeal in 2024 for up to 290 residential dwellings (including 30% affordable housing). Subsequently, BTF partnership were appointed as sole selling agents to invite offers to purchase the consented land through a second Informal Tender Process. After ‘best and final bids’ a national house builder was selected as the successful purchaser and BTF managed both an early surrender of the farm tenancy, to include tenant’s compensation for fruit plantings, and the commercial terms of the sale contract through to a successful conclusion for the landowner.
